The Lahore High Court (LHC) has delivered a significant judgment, emphasizing that a mother’s remarriage cannot be the sole basis for denying her the custody of her minor child. Justice Syed Ahsan Raza Kazmi, at the Bahawalpur Bench, allowed a writ petition filed by Miss. Nazia Siddique, setting aside previous court orders that granted custody to the father based on her remarriage and perceived financial dependence.
The court underscored that the paramount consideration in child custody cases is the welfare and best interest of the minor. It noted that shifting custody from the mother, with whom the child had been living since birth, solely due to remarriage could cause trauma. The court also considered the father’s delayed filing of the custody petition as a sign of a lack of genuine concern for the child. While granting custody to the mother, the court directed the establishment of visitation rights for the father.
